TXOGA and TAM have filed a joint Petition for Review with the Fifth Circuit Court of Appeals in New Orleans, challenging the EPA's formal disapproval of the "qualified facilities" program in Texas.  TXOGA has actively maintained that existing Texas air programs, including the qualified facilities program, complies with the federal Clean Air Act and is helping to dramatically improve Texas air quality.

The Texas Oil and Gas Association (TXOGA) and Texas Chemical Council (TCC) are working closely with Texas Commission on Environmental Quality (TCEQ) as the agency considers a plan to study flares.  TXOGA prepared the one-pager linked below to provide a framework of discussion with regulators and other interested parties.
